* Hare’s
objective was to trace the doctrine of consideration and to
show its influence on contracts in common law. Beginning with
Roman law, where the doctrine of consideration was unknown,
he proceeds to an examination of the practical importance of
the law of sales. This treatise was taken from a course of lectures
given by the author in the law school of the University of Pennsylvania,
where he also served as a trustee. Hare [1816-1905] edited a
number of selections and reports of cases and “...was one of
the half-dozen greatest judges that Pennsylvania has produced.
He ascended the bench just after equity was introduced, as a
general system, into Pennsylvania, and his contribution to its
establishment was of great importance.” Dictionary of American
Biography IV:262.

devoted exclusively to the subject. It deals with legal definitions
of lunacy, the disabilities of lunatics, asylums and their regulation
by statute, the nature of criminal insanity, and precedents
regarding the treatment of lunatics before the law for various
crimes.

of the first edition. This was the first book-length work to
examine the subject. As such, it is a landmark work in the bibliography
of American civil liberties. More important, this book, which
was published a year before John Brown’s raid and three years
before the outbreak of the Civil War, treats the status of slaves
at length. Hurd [1815-1874] reviews the statutes concerning
fugitive slaves and their extradition, analyzes the Fugitive
Slave Act of 1850 and discusses the application of habeas corpus
to slave issues. The list of cases cited by Hurd includes such
landmarks as Jack v. Martin and Prigg v. Pennsylvania. See Finkelman,

* In contract
law there are two types of mistake as determined by Savigny.
The first, echt, represents those cases in which consent
exists, but the contract is impeachable due to the determination
of mistake. This work examines the second class of mistake in
contract, unecht, “...in which real consent is lacking,
resulting in the nullity of the contract, while the mistake
is an accompanying feature” (Preface). This class of mistake
is traced from Roman law to common law and modern civil law.

of first edition. Parry [1863-1953] was an English municipal
judge for over twenty years. His book, a guide for “the man
in the street,” which began as a series of newspaper articles,
outlines the laws concerning insolvency, debt and poverty. It
is distinguished by its emphasis on cultural attitudes toward
the poor, and its readability and humanity. Parry’s was among
the strong voices to speak in sympathy to the poor in response
to the Poor Law Amendment Act which had been enacted in 1834.
“Judge Parry is particularly gifted with that rare imagination
which enables him to see mortal men and women where others see
cases, litigants, and parties before the courts. Hence his volume
is a rare document, especially useful as a corrective to the
tendency to lose sight of actual living conditions in the logical
pursuit of abstract legal doctrines.” Cohen, Law and Social
