Published by the American Law Institute (ALI) which was organized in 1923 following a study conducted by a committee of prominent American judges, lawyers and teachers. This committee reported that the two chief defects in American law were its uncertainty and complexity, both of which threatened the continuance of our common law system of expressing and developing the law.

The first undertaking of ALI was a direct attack on the uncertainty. It proposed a restatement of certain phases of the law that would tell judges and lawyers what the law was. This plan produced the Restatements of the Law.

Each subject is in the hands of one or more reporters, who are always among the leading authorities on the topic. The procedure is that successive tentative drafts are produced which are considered by the Institute at its annual meetings. When a text has been finally approved it is published in book form.
