Contemporary paneled vellum, corner fleurons and large central arabesques to boards, raised bands and early hand-lettered title to spine, "3" in tiny early hand to head of spine. Light soiling, boards slightly bowed, moderate rubbing to extremities, spine ends bumped, front joint starting at ends, corners bumped, illegible later signatures in tiny hand to recto and verso of front free endpaper. Title page, with large copperplate vignette, printed in red and black. Light to moderate toning, faint dampstaining in a few places, light soiling to title page. $1,250. * First edition. One of the most important jurists of his time, Bynkershoek was a Dutch jurist who founded the positive school of law, which held that usage and practice were more important than deductions drawn from natural law. Respected during his lifetime, his works are still consulted today. Best known for his works on international law, he also wrote important works on other legal topics, such as the present work, which considers questions dealing with private law under the Roman and Roman-Dutch systems. Published posthumously, an edition in Dutch was published in 1747. The final edition, in Latin, appeared in 1752 as part of a collected-works edition. All are scarce.
