Kaskaskia: Printed by Robert K. Fleming, 1831. xii, [4], 333, 39 pp. Octavo (9" x 5-1/2"). Contemporary sheep, blind fillets and lettering piece to spine, "Smith Turner/ Mason County/ State of Illinois" in bold hand, along with some faint illegible contemporary markings, to front board. Light rubbing and faint dampstaining to boards, moderate rubbing to spine and extremities with wear to corners, front hinge cracked. Moderate toning to interior, faint dampstining to head of text block, early signatures and annotations to preliminaries, one on front free endpaper stating this book belonged to Breese. $850. * First edition. This is the first compilation of Illinois Supreme Court cases. Though not authorized, the state sanctioned the publication by subscribing to 150 copies. It was reprinted with additions in 1861 and 1877. An important figure in the history of Illinois, Breese was a jurist who gained national prominence for his decision in Munn v. Illinois, upheld by the U.S. Supreme Court, favoring the regulatory power of the state over business corporations. His fifty-year career spanned the legal and political development of Illinois. Smith Turner was a lawyer, later a judge, in Mason County, Illinois from 1838 to 1861. The annotation regarding Breese states incorrectly that his signature is written above.
