Gilbert was a distinguished Whig judge and legal writer who served as chief baron of the court of exchequer from 1725 until the end of his life. He wrote two treatises on that court, which were published posthumously. The Treatise is one of them. The other is An Historical View of the Court of Exchequer (1738).
