Written in the wake of the Napoleonic Wars and the Congress of Vienna in 1814, this book was, as noted by Walker, "an attack on the code system imposed on much of Europe by Napoleon and....the advocacy by Thibaut of a German Code. He attacked the demand for a code on the grounds that it was impracticable, adequate juristic preparation being impossible and the German language being juridically underdeveloped, and that existing codes were unsuccessful."
