It was nearly impossible to obtain a divorce in Great Britain until the passage of the Matrimonial Causes Act in 1857, which allowed divorce by judicial process. The grounds for divorce were adultery, cruelty and desertion with the following conditions: A husband could obtain divorce for adultery, but a wife only for adultery with cruelty or desertion. Phillimore attacks the "evil" nature of this Act and its infringement on the role of the ecclesiastical courts. Phillimore is best known for his studies of Roman law and The Principals and Maxims of Jurisprudence (1856).
