[xii], ccxxx, 208 pp. Quarto (9-1/4" x 7"). Contemporary three-quarter calf over paper-covered boards, gilt rules to calf edges, gilt fillets and title to spine, marbled edges. Light rubbing and soiling to boards, front board separated but secured by cords, rear board detached, faint offsetting along edges of paper, moderate rubbing to extremities, chipping to spine ends, corners bumped and worn. Light toning to interior, negligible light foxing and faint offsetting to title page, internally clean. $600. * Only edition. Based on a work first published in 1707, this is, notes Holdsworth, "the most important of [Hale's] books on the constitutional law published by Hargrave with an elaborate preface in 1796. This topic comprised some of the most controverted political questions of the day; and Hale had written much upon it in the early days of the Long Parliament, the Commonwealth and after the Restoration. This essay...represents his final judgment on the matter; and he himself tells us that the MS was complete and only needed his final revision. (...)
