First published in 1824, this was the first American treatise on the law concerning streams, rivers and artificial waterways. It addressed a need for an exposition of the legal issues that responded to the rapid growth of water-powered industry and water-borne transportation during the nineteenth century. Regarding the first edition, Kent noted, "No intelligent lawyer can well practice without" this book. In successive editions, it remained a standard work for the rest of the century. This edition was heavily updated to include new legal precedents and matters that had developed since the original publication. Kent, Commentaries on American Law III:453.
