Stab-stitched pamphlet in printed wrappers. Light soiling and a few minor stains to exterior, two early owner signatures, "H. Louis Wallace" and, with cross-outs, "T.C. Callicot," to head of front wrapper, small bookseller ticket (Williamson Law Book Co., Rochester New York) to verso, moderate rubbing to extremities with some wear to spine ends and corners. Moderate toning to interior, faint dampstaining to head of text block in a few places. A very good copy overall. $350. * Only edition. "Mrs. Budge's death was first ruled a suicide; then her husband was tried, but acquitted. Her throat had been cut. After acquittal, Budge sued Caleb Lyon for calling him a murderer. Lyon's defense was that the allegation was true. Budge got a judgement of $100; he had sued for $20,000. Dr. Swinburne was Lyon's defense witness, and his pamphlet summarizes that trial. There is an interesting series of illustrations demonstrating the kinds of wounds made from different positions" (McDade). Swinburne went on to serve as mayor of Albany and represent New York in Congress from 1885-1887 in addition to his work as a physician. Theophilus Carey Callicot [1826-1920], a graduate of Yale Law School, was a notable Brooklyn lawyer, politician and newspaper editor. He was a member of the New York State Assembly from 1860 to 1863 and was its speaker in 1863. Appointed a customs official in 1865, he was.
