First Comprehensive American Treatise on Partnership Story, Joseph [1779-1845]. [Story, William Wetmore (1819-1895), Editor]. Commentaries on the Law of Partnership, as a Branch of Commercial and Maritime Jurisprudence. Boston: Charles C. Little and James Brown/London: A. Maxwell, 32 Bell Yard, Lincoln's Inn, Law Bookseller to His Late Majesty, 1846. xxiv, 720 pp. Octavo (9-1/2" x 6"; 24.13 x 15.24 cm). Contemporary sheep, blind rules to boards, raised bands, blind fillets and calf lettering piece to spine, blind tooling to board edges. Light fading and some shallow scuffs to sections of binding, moderate rubbing to extremities with wear to corners and head of spine, recent bookplate to front pastedown, front hinge starting. Light browning to endleaves with offsetting to margins, interior notably fresh otherwise. A very good copy. $450. * Second edition. Written during a period when Story was a U.S. Supreme Court justice and a professor at Harvard Law School, Story's treatises on commercial law were instrumental in shifting the framework of American law to a national, pro-business model. His treatise on partnership was his final work. First published in 1841, its final edition, the fifth, was published in 1859. It was a standard text in the United States and, to some extent, Great Britain during the nineteenth century. Warren, a contemporary critic, said it is "a truly luminous exposition." In 1938 Pound included it in his list of texts that were "a significant force in our legal development." Warren, Law Studies 451. Pound, The Formative Era of American Law 140. Cohen, Bibliography of Early American Law 9322.
