Rare 1806 Boston Court Martial Pamphlet of the Trial of Captain Joseph Loring [Trials]. Loring, Joseph, Jr., [1767-1838], Defendant. [2], iii, [2], 4-82 pp. Modern boards, recent cloth rebacking, paper label to front board. Light soiling and rubbing to boards, heavier rubbing to board edges. Fading to top edges of boards. Spine joint cracked, but holding. Bookseller's ticket "Gaylord Bros./ Syracuse, N.Y." to rear pastedown. Moderate toning, somewhat heavier in places, occasional light foxing. Modern front free endpaper detached with some penciling, small tear to head of title page, otherwise internally clean. A very good copy. $450. * An important early American military trial documenting the court-martial of Captain Joseph Loring of the Massachusetts Militia. Brigadier General John Winslow accused Loring of permitting his men to mutiny by failing to enforce a brigade order to appear on parade (intended as a protest against a change in Winslow's rank and command). Formally acquitted by a division court-martial in 1805, Loring's case was forcefully reopened by Major General Simon Elliot, who dissolved the court after it refused to reconsider. A second court-martial in 1806 found Loring guilty, resulting in his removal from service. Loring petitioned the Massachusetts General Court in 1807, arguing that the unconstitutionally detailed secondary court denied him an impartial trial. The General Court ultimately invalidated the 1806 decision and ordered Loring reinstated to his former rank and command.
